1. Acceptance of Terms
By accessing or using Waterfall's website, mobile application, APIs, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Services.
2. Nature of the Service
Waterfall collects structured wisdom and life experience from seniors and makes this wisdom available through AI models and APIs. The wisdom, guidance, insights, and responses provided through our Services are derived from real human experiences and processed through artificial intelligence systems.
3. NOT Professional Advice — Important Disclaimer
THE WISDOM, GUIDANCE, AND RESPONSES PROVIDED THROUGH WATERFALL'S SERVICES — INCLUDING BUT NOT LIMITED TO THE WISDOM MODEL API, THE WATER EMOTIONAL INTELLIGENCE ENGINE, AND ANY CONTENT DISPLAYED ON OUR PLATFORMS — ARE NOT AND SHOULD NEVER BE CONSTRUED AS:
• Professional medical, psychological, or psychiatric advice
• Licensed legal counsel or legal advice
• Certified financial, investment, or tax advice
• Professional counseling or therapy
• Emergency crisis intervention
• A substitute for professional judgment in any regulated field
The wisdom shared through Waterfall reflects the personal life experiences, opinions, and perspectives of individual seniors. While valuable, these perspectives are subjective and may not be applicable to your specific situation. Always consult qualified professionals for medical, legal, financial, mental health, or other professional matters.
4. No Guarantee of Outcomes
Waterfall makes no representations, warranties, or guarantees — express or implied — that following any wisdom, guidance, or suggestion provided through our Services will result in any particular outcome. Life decisions are inherently complex and context-dependent. What worked for one person in one situation may not work for another. You assume full responsibility for any decisions you make based on information obtained through our Services.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WATERFALL, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AND CONTRIBUTING SENIORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from decisions made based on wisdom or guidance obtained through the Services
• Damages resulting from any reliance on the accuracy, completeness, or usefulness of any content
• Personal injury or emotional distress arising from use of the Services
• Any unauthorized access to or alteration of your data
In no event shall Waterfall's total liability exceed the amount you paid to Waterfall in the twelve (12) months preceding the event giving rise to the claim.
6. Assumption of Risk
You acknowledge and agree that:
• Wisdom is inherently subjective and culturally contextual
• AI systems may introduce errors, biases, or misinterpretations in processing human wisdom
• No AI system can fully capture the nuance of human judgment and lived experience
• The emotional intelligence signals provided by the Water engine are probabilistic estimates, not clinical assessments
• You are solely responsible for evaluating the appropriateness of any guidance for your situation
7. Wisdom Contributors
If you contribute wisdom as a senior participant, you acknowledge that:
• Your contributions will be processed, anonymized, and potentially used to train AI models according to your consent tier
• You may revoke consent at any time, and your data will be removed per our data deletion policy
• You will be compensated according to the revenue-sharing terms in effect at the time of contribution
• Waterfall is not responsible for how third-party developers use wisdom accessed through our API, provided they comply with our Developer Terms of Use
8. Developer API Usage
Developers accessing wisdom through the Waterfall API agree to:
• Not misrepresent AI-generated guidance as human professional advice
• Display appropriate disclaimers to end users when presenting wisdom-based responses
• Not use the API in life-critical, emergency, or high-stakes automated decision systems without human oversight
• Comply with all applicable laws regarding AI-generated content in their jurisdiction
• Not attempt to re-identify anonymized wisdom contributors
9. Emergency Situations
Waterfall is not an emergency service. If you or someone you know is in crisis, experiencing suicidal thoughts, or facing immediate danger, please contact emergency services (911 in the US) or the 988 Suicide & Crisis Lifeline immediately. Our Services are not designed or equipped to handle emergency situations.
10. Indemnification
You agree to indemnify, defend, and hold harmless Waterfall and its officers, directors, employees, agents, and contributing seniors from and against any and all claims, damages, obligations, losses, liabilities, and expenses arising from your use of the Services or your violation of these Terms.
11. Modifications
Waterfall reserves the right to modify these Terms at any time. We will notify users of material changes via email or prominent notice on our website. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
